MANILA, Philippines &#8211; Nagdiwang ang mga guro sa Metro Manila makaraang itaas ng Department of Education (DepEd) ang ibinibigay na “clothing allowance” nila.
Sinabi ng Alliance of Concerned Teachers (ACT) na nagbunga ang panawagan nila sa dagdag na kompensasyon para sa mga guro na inum­­pisahan nila noong 2011 sa paghiling na itaas ang clothing allowance sa P6,000 kada taon.

<p>Nagsagawa ang mga guro ng sunod-sunod na demonstrasyon at dayalogo sa mga opisyales ng pamahalaan. Kasama dito ang pagliham kay Education Secretary Armin Luistro na maaaring itaas ang clothing allowance sa P5,000 na maipagkakasya naman sa pondo ng ahensya base sa <a id="KonaLink1" href="http://www.philstar.com/Article.aspx?articleId=776864&amp;publicationSubCategoryId=92#"><span style="color: blue;">GeneralAppropriations Act</span></a> of 2012.</p>
<p>Sa huling dayalogo ngayong taon kay DepEd-NCR budget chief, Paul Garcia, inihayag nito na itinaas na sa P5,000 ang clothing allowance ng mga guro sa Metro Manila.</p>
<p>“Fellow teachers, let us claim and rejoice our victory,” ayon kay France Castro, secretary-general ng ACT.</p>
<p>Sa kabila ng tagum­pay, sinabi ni Castro na patuloy pa rin nilang ipag­lalaban ang iba pang pangangailangan sa edukasyon tulad ng dagdag na mga guro, regularisasyon ng mga kaswal at volunteer na guro, dagdag sa suweldo at iba pang benepisyo.</p>

<p>A legislator on Wednesday sought to raise to P60,000 from the current P30,000 ceiling the total exclusion from gross income of the 13th-month pay and other benefits of State workers and  private employees to increase their take home income for their families.</p>
<p>House Bill 5661, will complement House Bill 4177 that seeks to increase the ceiling for total exclusion of the Christmas bonus and other benefits from the computation of taxable income from P30,000 to P40,000 to provide workers and employees reprieve from the country’s worsening economic condition.</p>
<p>In filing HB 5661, Party-list Rep. Antonio Tinio of Act Teachers wants to amend Section 32 (B) (7)(e) of the National Internal Revenue Code (NIRC) so the 13th-month pay and other benefits received by officials and employees of government and private-sector workers shall not be included in gross income and shall be exempt from taxation, provided that the total exclusion shall not exceed P60,000.</p>
<p>Tinio said his proposal is in support of Article ll, Section 18 of the Constitution which recognizes labor as a primary socioeconomic force and affirms the mandate of the State to protect the rights of workers and promote their welfare.</p>
<p>Tinio noted that despite this constitutional provision, majority of salary and wage earners in the private and public sectors suffer from “indecently low pay” as well as from meager benefits.</p>
<p>“With respect to employees in the civil service, their salaries oftentimes stagnate for long periods due to the failure of Congress to periodically amend the Salary Standardization Law. Workers in the private sector, on the other hand, have their wages tied to the politics and bureaucracy associated with the wages and productivity boards,” Tinio said.</p>
<p>The misery on wages, Tinio said is compounded by the present income taxation law as he noted that even without considering the unrestrained inflation in prices of commodities and services, salary increases are hardly felt by employees in the public and private sectors.</p>
<p>“Whether the increases are caused by salary upgrading in a few agencies of the government, the implementation of the Salary Standardization Law 3, or regional wage hikes, the taxable incomes of employees also increase, and most of them become subject to higher tax rates,” said Tinio.</p>
<p>He said the 13th-month pay and other benefits, generally based on the basic pay, also increase. In most cases, the present P30,000 ceiling for a total exclusion of these benefits apply, thus subjecting the excess of P30,000 to income tax.</p>

<p>ACT Teachers Party-List Representative Antonio Tinio has filed House Bill 5809, which seeks to amend the Foreign Currency Deposit Act of the Philippines (Republic Act 6426) by revoking the absolute confidentiality conferred upon foreign currency deposits, allowing their examination &#8220;in cases of impeachment, or upon order of a competent court in cases of bribery or dereliction of duty of public officials, or in cases where the money deposited or invested is the subject matter of the litigation.&#8221; The bill also removes the exemption granted to foreign currency deposits from any form of governmental order or process. &#8220;These privileges granted by law to foreign currency deposits effectively place them beyond the reach of government,&#8221; noted Tinio.</p>

<p><strong>EXPLANATORY NOTE</strong></p>
<p>In 1977, Presidential Decree 1246 conferred an &#8220;absolute cloak of confidentiality&#8221; over foreign currency deposits and exempted them from &#8220;attachment, garnishment, or any other order or process of any court, legislative body, government agency or any administrative body&#8221; to &#8220;better encourage the inflow of foreign currency deposits&#8221; into Philippine banks that could channel these funds into loans and investments, and thereby contribute to the country&#8217;s economic development.</p>
<p>Subsequent developments have rendered obsolete these special protections provided by law to foreign currency deposits. While there may have been a relative scarcity of foreign currency in the domestic banking and financial system in the 1970s, this is clearly no longer the case today. Remittances by Overseas Filipino Workers, totaling over US$ 18.3 billion in the first 11 months of 2011, on top of traditional sources of foreign currency, ensure that the country&#8217;s foreign exchange reserves are at an all-time high.</p>
<p>Furthermore, recent events have shown how the absolute and unqualified secrecy of foreign currency deposits, and their exemption from government orders or processes, may be exploited to cloak financial transactions by individuals and entities involved in illegal activities. For instance, government officials, including those conferred with immunity from suit during their incumbency and removable only through impeachment, may make use of foreign currency deposits to amass ill-gotten wealth with the assurance that these will be virtually beyond the reach of the State.</p>
<p>This bill proposes amendments to Republic Act 6426 (the Foreign Currency Deposit Act of the Philippines) that, while maintaining the secrecy and confidentiality of foreign currency deposits, allows their examination in certain exceptional cases, such as impeachment, or upon the order of a competent court. In addition, it proposes that their exemption from governmental orders or processes be removed. If this bill is enacted into law, foreign currency deposits will, in these respects, enjoy the same level of protection as deposits in the national currency.</p>

<p><strong>AN ACT AMENDING SECTION 8 OF REPUBLIC ACT 6426, OTHERWISE KNOWN AS THE “FOREIGN CURRENCY DEPOSIT ACT OF THE PHILIPPINES”</strong></p>
<p><strong> </strong></p>
<p><em>Section 1.</em> Section 8 of Republic Act 6426 (“Foreign Currency Deposit Act of the Philippines”), as amended by Presidential Decree No. 1035, and further amended by Presidential Decree No. 1246, is hereby amended as follows:</p>
<p>Section 8. Secrecy of foreign currency deposits. – All foreign currency deposits authorized under this Act, as amended by PD No. 1035, as well as foreign currency deposits authorized under PD No. 1034, are hereby declared as and considered of an absolutely confidential nature<strong> [</strong>and, except upon the written permission of the depositor, in no instance shall foreign currency deposits be examined, inquired or looked into by any person, government official, bureau or office whether judicial or administrative or legislative, or any other entity whether public or private;<strong>].</strong> <strong>IN NO INSTANCE SHALL FOREIGN CURRENCY DEPOSITS BE EXAMINED, INQUIRED OR LOOKED INTO BY ANY PERSON, GOVERNMENT OFFICIAL, BUREAU OR OFFICE WHETHER JUDICIAL OR ADMINISTRATIVE OR LEGISLATIVE, OR ANY OTHER ENTITY WHETHER PUBLIC OR PRIVATE, EXCEPT UPON THE WRITTEN PERMISSION OF THE DEPOSITOR, OR IN CASES OF IMPEACHMENT, OR UPON ORDER OF A COMPETENT COURT IN CASES OF BRIBERY OR DERELICTION OF DUTY OF PUBLIC OFFICIALS, OR IN CASES WHERE THE MONEY DEPOSITED OR INVESTED IS THE SUBJECT MATTER OF THE LITIGATION. [</strong>Provided, however, That said foreign currency deposits shall be exempt from attachment, garnishment, or any other order or process of any court, legislative body, government agency or any administrative body whatsoever.<strong>]</strong><strong> </strong></p>
<p><em>Section 2.</em><strong> </strong>All laws, decrees, resolutions, orders, or ordinances or parts thereof inconsistent with this Act are hereby repealed, amended or modified accordingly.</p>
<p><em>Section 3.</em> This Act shall take effect fifteen (15) days after its publication in the <em>Official Gazette</em> or one (1) newspaper of general circulation.</p>

<p>MANILA, Jan. 22 — The move to increase to P4,000 the P2,000 monthly Personnel Economic Relief Allowance (PERA) granted to government employees is fast gaining ground in the House of Representatives.<br />
This as ACT Teachers party-list Rep. Antonio Tinio filed House Bill No. 5662 seeking the timely increase of the PERA to supplement the basic compensation of state workers due to the rising cost of living.<br />
&#8220;An increase in the PERA will offer government personnel more substantial relief from the erosion of the purchasing power of public sector salaries and wages,&#8221; he said.<br />
Tinio said the PERA was first granted to government employees in 1991, in the amount of P500 per month. An additional compensation of P1,500 was given by virtue of Joint Resolution no. 4 issued by Congress on June 17, 2009 totaling to P2,000.<br />
&#8220;The PERA is granted monthly to all public sector employees, whether paid on salary, wage or base pay basis across all agencies. This benefit is considered as a supplement to their basic compensation,&#8221; he said.<br />
Under the measure, the augmentation of the PERA shall be referred as the Augmented Personnel Economic Relief Allowance (APERA).<br />
This shall be granted to civilian government personnel whether employed by the national or local governments, appointive or elective, and whether occupying regular, contractual or casual positions covered by Republic Act No. 6758, otherwise known as the &#8220;Compensation and Position Classification Act of 1989,&#8221; as amended, as well as military and uniformed personnel.<br />
However, government personnel stationed abroad already receiving overseas allowances are not entitled to APERA.<br />
For the first year of implementation, Tinio said, the funds for the APERA of national government agencies shall be charged against savings, which include unreleased appropriations and other programmed appropriations.<br />
The amount shall be included in the annual General Appropriations thereafter.<br />
Meanwhile, the budget for local government units (LGUs) shall be charged against their local funds and any deficiency shall be charged against the balances of their Internal Revenue Allotments (IRAs), which are authorized to be realigned for the purpose. The amount necessary for the APERA shall thereafter be provided in their respective local budgets.<br />
HB 5662 mandates the Department of Budget and Management (DBM) to issue the implementing rules and regulations for the effectivity of this Act. (PNA)</p>
