HB 5735, the “Student Discipline and Teacher Protection Act”

Rep. Tinio today filed House Bill 5735, or the “Student Discipline and Teacher Protection Act.”

“While child protection is indispensable, teacher protection is also a must. To this end, this bill seeks to lay down institutionalized support mechanisms for teachers and school personnel in matters of classroom management and student discipline. The first is a mandate n DepEd to issue and implement a student manual. DepEd is also proposed to provide pre-service and in-service training for DepEd personnel on child behavior and psychology, classroom management techniques, positive discipline, and other related fields.

“Also proposed are measures to protect teachers and school personnel in cases related to student discipline and classroom management, including legal assistance and representation by counsel and union representatives. Furthermore, confidentiality of proceedings and the identity of all parties are directed.”

    It’s about time they pass this law to protect the school teachers from any harm and from abusive parents. Some teachers are experiencing treat thru text and verbal. This is a good start to protect our low income school teachers. To me, a teachers is a valuable assets to the whole wide world, with out them children will be left out (meaning can not read and write). So thank you to the HB 5735.

    This HB will not be passed into law the same with the HB filed for our salary increase because it needs support from the majority of the congressmen. Our representative in congress allied himself with the minority and criticize every move of the administration. Can we expect support for our cause given the kind of politics we have in our country?

      If we teachers ourselves are negative about this bill, how can it earn support from the rest of us? Remember that our ACT Partylist Representative has passed already several bill for the benefit of not only the teachers but all government employees. I hope this will become a law.

    To whom it may concern, even Laws relative to the protection of teachers and school personnel will be created, as long as Juvenile delinquent laws will not reconciled to the rights and protection of teachers or that will penalize
    children who committed violations against teachers and school personnel, as long as Laws related to child Protection Policy is a one sided laws that over protecting their right without considering their act of omission or commission I think in my own opinion the move will be in vain. I’m not sure if we have Juvenile Delinquent Court that will handle cases of children. Sana magkaroon ng malinaw na plano ang pamahalaan tungkol sa mga bagay na ito. Yong mga batang nagnanakaw, nakagawa ng ibat-ibang krimen saan sila ngayon. Nakalalaya pa rin kasi walang malinaw na policy ang gobyerno. Huhulihin ng Pulis, I ta turn over sa DSWD, then sa magulang pagkatapos balik ulit sa lansangan at balik sa dating gawi. How much more if sa teacher ito mangyari, a student commits an act that will endanger his life and the teacher just depend himself? Dito talo na ang teacher kung nasaktan ang bata because of the CHILD PROTECTION POLICY>

        Totoo po yon that the role of a teacher is to do his best, to guide a child, to mold them, discipline them as long as we he control them. Hindi po ba yan din ang DAPAT na tungkulin ng bawat magulang na nagpapa-aral ng anak specially sa public schools. Assuming po that both teachers and parents did their duties and responsibilities in rearing a student but the student himself committed an act by omission or commission, how can we discipline him? Kasi nga po over protected sila (mga bata) ng Laws. Kasi nga po walang malinaw na plano ang GOBYERNO, specially ang DSWD na napakalaki ng PONDO para sa mga bata like batang hamog, rugby children, street childred and even school children who committed crime and other violations. I sited an example na applicable kahit anong uri ng bata, Bata nanasakit ng teacher, hindi nagpapaawat at uulitin pa yong pananankit, sa ngalan ng self defense, unintensionally naitulak ni teacher yong bata, kung ikaw ang teacher ano ang gagawin mo. Paano mo idedepensa ang sarili mo sa kasong child abuse. Assuming guilty and proven na nagkasala yong bata ano ang mangyayari kay teacher wala. sa bata? Wala rin. kasi hindi pwedeng ikulong. kasi bata. Pero kung may Juvenile Court na hahawak ng kaso para sa mga bata at may isang PROGRAMA ANG GOBYERNO para sa kanila, mas maganda. Halimbawa; si bata nakagawa ng krimen, sa ngayon huhulihin ng pulis, ng barangay ita-turn over sa DSWD ibabalik sa magulang, babalik sa community at balik sa dating gawi na gagawa uli ng krimen. Bakit? Kasi walang kinakatakutan. Pero kung may programa ang gobyern o DSWD na ilagay sila sa ampunan, mag-aaral sila hanggang makatapos ng high school kung saan matutoto sila ng skills para magamit sa paghahanap-buhay, di b mas maganda. Paglabas nila talagang REHAB na sila, matured na sila at sure ako hindi na sila babalik sa dati dahil hindi na sila BATA.

        Ang trying the best ay malabo. Nililimitahan iyan ng Child Protection Policy. Hindi pwedeng mag -lay down ng takot ang isang teacher para matakot ang isang bata sa paggawa ng masama. Hindi pwedeng mag-impose ng discipline dahil ang discipline ay laging may katapat na punishment.Hindi rin lahat ng bata ay tumatanggap ng turo mula sa mga kwento, aralin, pangaral at paliwanag. Sabihin na nating maraming parents ang nakakaintindi pero ang nag iisang parent na ayaw niyang masaway ang kanyang anak sa school ay pwedeng sisira sa reputasyon ng isang teacher sapagkat pag- sinabi ng isang parent na napahiya at natakot ang kanyang anak(na hindi naman nangyari) sa DSWD at sa mga sumusuporta sa child protection for sure ang guro’y sasampahan ng kasong child abuse at tatanggap ito ng warning at pagpapahiya.

    i suggest that a bill be passed not only to support teachers but protect them from abusive parents and students,.. because of the child protection policy some people tend to take advantage of their rights.

    This bill is good. Pero sana it will state clearly that “whoever attacks a teacher, whether a child (specially those in high school), a parent, an outsider” shall face a criminal offense. Marami na akong kilalang teachers na humarap sa legal situations dahil lang sa bias na child protection policy na yan! ACT, can you also draft a bill entitled “Teacher Protection Policy”???

    I am grateful really of what you have done. Every little salary increase due to your initiatives has meant a lot to me. I am a teacher I. Pero walang natitira sa suweldo ko na 18 549 na 15,000+ nlng kapag dumarating sa akin. 4 ang mga kapatid kong pinag-aaral ko at nagstop na nga ang karamihan sa kanila ngayon dahil lugmok na ako sa utang. Kailangan ko pang magpadala sa mga magulang ko. Hindi ako makapag-ipon dahil walang maipon.

    dito sa occidental mindoro hindi pa ibinibigay hanggang ngayon ang 2k productivity na dapat ay february pa natanggap ng mga guro pati chalk allowance. pakikalampag naman po Rep. Tinio ang deped thanks.

    Sana po ang teachers day celebration,mga guro ang pinasasaya,mabigyang halaga ang anong sakripisyo,Hindi yung kailangan pa naming mahirapan,gumastos makabuo lang ng sayaw na pang festival for competition para daw sa teachers celebration sa october 5,

    Child abuse is very broad and while a simple reminding and warning an unruly child could be considered as psychological abuse ( some could insist that this could intimidate and left the child traumatic) imposing pupils or student discipline is not possible. Child abuse must be categorized and enumerated specifically so that it limits are clear and no need for lawyers interpretation.

    Tali ang kamay ng mga guro na magpa-iral ng disiplina. Gaya-gaya tayo sa US, sobrang laya ng mga bata, wala nang kinatatakutan. Kailangang may katakutan ang mga bata dahil ang takot ay binigay ng Dios upang maprotektahan ang sangkatauhan. Kailangang may naka-install na sistema ng pag “kick out” at “expulsion” sa mga batang paulit ulit na gumagawa ng masama. Maging mahigpit din tayo sa pagpasa, ibagsak ang dapat ibagsak at huwag doktorin ang grades at mag “pasang-awa” na kung tutuusin ay hindi tunay na “awa” at hindi rin tunay na “pasado”.
